The Supreme Court of Indiana is standing behind the Economic Loss Doctrine in a case involving design and construction defect claims against an architect and subcontractors to the architect:

Economic losses concern defeated or diminished expectation interests arising out of inadequate or failed contractual performance, which involve neither personal injury nor physical damage to other property.
